Wellness Duty may periodically revise these terms, so we suggest reviewing this page regularly for any updates. The term "You" or "User" refers to any individual who accesses this site. You are permitted to view a single copy of the Website content, including text, graphics, images, etc., for personal, non-commercial use only. This content is protected by U.S. and international laws, and unauthorized use may infringe these laws.

Utilizing Services

By using our Services, you acknowledge that we do not guarantee the accuracy, reliability, completeness, truthfulness, or legality of third-party content. Additionally, we have no control over the integrity, responsibility, or actions of Job Seekers or Clients.

Service Eligibility

To use our Services, you must be at least 18 years old or the age of majority in your jurisdiction, allowing you to form a legally binding agreement with Wellness Duty. If you are under eighteen (18) or the age of majority but are legally permitted to work, a parent or legal guardian must review and agree to this Agreement on your behalf. You are not permitted to use our Services if your access has been previously suspended or terminated by Wellness Duty, unless explicit written permission is granted for re-access.

Email Communication Consent

By providing your email address to Wellness Duty, you consent to receiving service-related communications and important notices, including those legally required, via email instead of traditional mail. Additionally, we may use your email to send updates about changes to service features and special offers, as permitted by law in your jurisdiction.

User Conduct Agreement

As a user, you commit to the following actions:

  • Refraining from unauthorized duplication, sharing, or exposure of any part of the Services
  • Avoiding the use of automated systems that burden our servers with excessive requests
  • Not sending spam, unsolicited messages, or attempting to compromise the integrity or security of our systems.
  • Refraining from actions that cause undue stress on our infrastructure or uploading malicious software or data through the Services. Avoiding unauthorized collection or aggregation of personal information
  • Not using the Services for commercial purposes, impersonation, or misrepresenting your affiliation
  • Refraining from disrupting the proper operation of the Services or accessing them through unauthorized methods
  • Not providing false or misleading information or offensive content. Wellness Duty retains the authority to define what constitutes offensive material.

Forbidden User Content

The following guidelines detail the types of User Content that are strictly forbidden. This list is illustrative and not exhaustive. You agree not to post or provide User Content that:

  • Presents a risk of harm to any individual or property
  • Provides advice or information on unlawful activities
  • Includes unsolicited or unwanted messages or communications, such as 'phishing' or 'scamming'
  • Contains links to illegal or offensive material, or seeks to collect Personal Data from minors under 18
  • Contains information or content deemed illegal, harmful, abusive, racially or ethnically offensive, defamatory, invasive of privacy or publicity rights, harassing, demeaning to others (publicly or privately), libelous, threatening, vulgar, or otherwise objectionable
  • Contains any illegal information or content, including the disclosure of insider information under securities law or another party's trade secrets
  • Includes information or content that you do not have the legal right to distribute under any law, contractual obligation, or fiduciary duty
  • Contains any information or content that is false, misleading, or deceptively inaccurate
  • Infringes upon the Intellectual Property Rights or privacy rights of any third party. For the purposes of this Agreement, "Intellectual Property Rights" include patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights, and other intellectual property rights as may currently exist or come into existence, along with all applications, registrations, renewals, and extensions thereof, under the laws of any state, country, territory, or other jurisdiction.

If you are a Client supplying or submitting Job Advertisements, you additionally agree that such content shall not include any personally identifiable information.

Disclaimer and Limitation of Liability

You acknowledge the possibility of encountering inaccurate, misleading, illegal, offensive, or inappropriate User Content and agree that it is your responsibility to verify its quality, truthfulness, and legality. Any reliance on User Content is at your own risk. Nonetheless, Wellness Duty reserves the right to refuse, remove, or suspend User Content and User Accounts that violate this Agreement, any additional agreements with Wellness Duty, applicable laws or regulations, infringe third-party rights, or pose potential liability or harm to Wellness Duty, even though Wellness Duty is not required to monitor User Content.

Acknowledgment of Risk in User Interaction

You acknowledge and agree that Wellness Duty does not have the capability or obligation to verify the identity or authenticity of Users. Wellness Duty is not responsible for validating any Users. It is your responsibility to conduct thorough due diligence before engaging with Users, including job applicants, employers, recruitment agencies, and consultants.

You accept all risks associated with interactions with any User you meet through the platform. Any issues or disputes must be handled directly with the User in question.

By agreeing to these terms, you release and hold Wellness Duty, its affiliates, and their employees, directors, and agents harmless from any claims, demands, or damages, including direct, indirect, consequential, or incidental damages, whether known or unknown, disclosed or undisclosed, to the maximum extent allowed by law.

User Content and Information Disclosure

Wellness Duty is entitled to disclose User Content and relevant information to third parties as necessary. We may also release such information to protect Wellness Duty’s interests as needed. By accepting these terms, you consent to the potential disclosure of your identity to third parties who claim that any User Content you have provided is fraudulent, misleading, illegal, infringes on their intellectual property rights, or breaches their privacy rights.

Commercial Use Restrictions and Confidentiality Agreement

You agree not to resell, assign, or commercially exploit the Website without explicit authorization. All information, including code and business, technical, or financial details obtained from us, is considered confidential. Disclosure of Confidential Information is prohibited except when legally required.

Rights and Feedback Usage

All rights to the Service, except for user-generated content, are held exclusively by Wellness Duty and its licensors. The Service is protected under copyright, trademark, and other applicable laws. Any feedback, comments, or suggestions you provide are given voluntarily and may be used by us without any obligation to provide compensation.

Legal Compliance for International Access

Accessing Wellness Duty's content from outside the United States is not assured to be legal. If you choose to do so, you must follow your local laws. If any part of these terms is declared invalid by a competent court, the rest will continue to apply. These terms represent the full agreement between you and Wellness Duty, and any changes made will be effective immediately. Continued use of the Service means you agree to the revised terms.

Terms of Use and Prohibited Conduct

Users must use the Website in accordance with the law and respect others rights, avoiding any activities that infringe on copyrights, trademarks, or personal rights, and ensuring that no content is defamatory, obscene, threatening, abusive, or hateful. Unauthorized access or interference with the Website’s security is prohibited. Violations may result in legal actions, and we may engage with law enforcement to deal with offenders. The Website is designated for use by job seekers and employers only. Users must refrain from providing false information, promoting upfront fee business opportunities, misusing the Website’s database, sending unsolicited promotional content, modifying others content or overloading the Website.
